A police officer who reasonably suspects a person is committing or is apparently in charge of a residential premises committing unreasonable noise may:

  • Direct a person to take any action considered necessary to prevent the unreasonable noise
  • A direction can remain in force for any period of time up to 72 hours

Emit or permit unreasonable noise from residential premises (involving use of a prescribed item during a prohibited time) [EPA s.167] - [INFRINGEMENT CODE 0222]

  • Emits or permits noise from a residential premises; and
  • The noise is from a prescribed item; and
  • The noise is during a prohibited time; and
  • The noise can be heard from another residential premises in a room other than a kitchen, storage area, bathroom, laundry, toilet or pantry.
  • There is no requirement to give a person a direction prior to charging/infringing for this offence

Fail to comply with direction by a police officer regarding unreasonable noise from residential premises [EPA s.175] - [INFRINGEMENT CODE 0228]

  • A person who fails to comply with a noise direction given as above.
